Video surveillance of public places by SIA Skrivanek Baltic for the purpose of ensuring public order and protection of immovable property

1. What is the purpose of video surveillance?

SIA Skrivanek Baltic carries out video surveillance for the prevention and detection of crimes and offences related to the protection of real estate, for the safety of the public, customers, employees and vital interests of persons, including the protection of life and health and public order, office work and services. The decision to install and record video surveillance equipment has been taken by SIA Skrivanek Baltic after assessing whether video surveillance can achieve the stated objective.

2. Where is the video surveillance carried out?

Video surveillance is carried out along the outer perimeter of the immovable property of SIA Skrivanek Baltic – office building at Lāčplēša iela 87C, Riga, including the parking lot, as well as the carriageway of Lāčplēša iela. Indoor video surveillance is carried out in the public area of the ground floor of the customer service area, which includes a separate employee workplace, entrance and waiting area.

3.3. Legal basis for video surveillance – Article 6, Paragraph one, Points c, e and f of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation). Respect and protection of the substantial public interest.

3.4. Legitimate interests: prevention of crime, maintenance of public order.

3.5. Recipients of personal data – the Controller and its authorised employees, the data subject, where applicable, national law enforcement authorities (State Police, investigative authorities, courts, etc.).

3.6. Personal data are not intended to be transferred to a third country which is not a Member State of the EU or EEA or to an international organisation.

4. When and for how long is the data recorded on video surveillance stored?

The retention period of video recordings is one (1) month. Video surveillance data which establishes a threat to public order, a criminal offence, a wanted person or a vehicle shall be kept until the conclusion of criminal proceedings, administrative offences proceedings, administrative proceedings or a departmental review by the police authority, but not longer than three (3) years.

5. Data security

The data obtained from the video surveillance recording shall be stored in such a way that third parties do not have access to them. No backup copies shall be made of the video surveillance recordings and the data shall not be disclosed to third parties, except in cases provided for in external laws and regulations (for example, if the information needs to be disclosed to law enforcement authorities). In cases where it is necessary to inspect personal data recorded in video surveillance and to lawfully disclose the data to other persons, SIA Skrivanek Baltic records data on to whom (identifying the person), when, for what purpose and what data have been disclosed.

6. The data subject has the right to:

6.1. obtain the information collected about him or her for the purpose of processing personal data as set out in Paragraph 1;

6.2. obtain information about those natural or legal persons who have received information about that data subject from the controller within a specified period of time. The information to be provided to the data subject shall not include public authorities that are conducting criminal proceedings, subjects of operational activities or other authorities about which the law prohibits disclosure of such information;

6.3. if the data subject requests information in relation to video surveillance, the data subject is obliged to provide, at the controller’s request, the information necessary to identify the data subject and the personal data requested;

6.4. within one (1) month from the date of the relevant request, receive free of charge the information referred to in this Paragraph or a reasoned written refusal to provide all or part of the information referred to in this Paragraph. The provision of information may be refused if the data subject refuses to comply with the obligation set out in Paragraph 6.3.

6.5. request rectification or erasure of the data or restriction of processing in relation to the data subject.
